Divorce

Divorce is an emotional and painful experience. It represents the death of a relationship and end of a marriage. Every divorce has an psychological and financial component. Every divorce is different, as the facts of every person’s life are different. Because your divorce in New Jersey is personal to you, our representation will focus on the facts and circumstances of your particular case.

Your divorce is a major life transition, and at the Law Offices of Laura M. D’Orsi we recognize that. You and your spouse may have a relatively amicable relationship. If you do, we will try to help you maintain that. You may have already reached an agreement on the division of your assets and want to enter into an agreement to co-parent your children. Or you may just want to divide your assets and move on with your separate lives. You may be seeking joint custody or sole custody of your children. You and your spouse may be able to amicably resolve the issues of division of property, alimony, child support and custody and parenting of your children.

On the other hand, you may have a difficult spouse who is abusive and belittling and insisting on obtaining custody of your children. You may be a victim of domestic violence and need to obtain a domestic violence restraining order. Your spouse may be telling you that you will not receive support or marital assets.

No two people are exactly alike and no two people experience divorce in the exact same way. While your divorce may be inevitable and you have no choice, you do have a choice when it comes to how you get divorced.

There are three primary options for getting a divorce.

Litigated Divorce

This is probably still most common and traditional model of divorce. It is important to understand that the majority of ” litigated” divorce case do not end up in court. Many couples reach an agreement without going to court. There are times when you have no other option but litigation. There are times when you simply must stand up to your spouse to protect your rights and interests and those of your children.

Collaborative Divorce

Collaborate divorce is a fairly new process where a couple makes a commitment to working out a divorce settlement without going to court and with the help of their own attorney’s and a team of collaboratively trained professionals.

Divorce Mediation

And in divorce mediation, a mediator helps the couple identify issues that need to be resolved, share pertinent information and reach an agreement.
