Whatever the reason, the only way to legally change a name in New Jersey is through a formal name change application filed in the Superior Court of the county where you reside.

Filing the Application

Your name change petition must include the name you wish to adopt, along with a disclosure of any criminal history, bankruptcy filings, or other legal matters. The Court wants to ensure that the request is not being made for fraudulent or unlawful purposes.

Once your petition is filed, notice of your application must be provided to various government agencies, such as the New Jersey Division of Criminal Justice, the County Prosecutor’s Office, and in some cases, the Office of Vital Statistics. These agencies are given the opportunity to object, though objections are rare if the request is legitimate and properly filed.

Court Hearing

If there are no valid objections, the Court will schedule a hearing date. At the hearing, the Judge may ask you a few questions to confirm your reasons for seeking the change. If satisfied, the Judge will issue an Order legally granting the name change. Once approved, you can use the certified Order to update your identification, financial accounts, and personal records.

Special Considerations for Children

When it comes to changing a child’s name, the Court applies additional scrutiny to ensure the change is in the child’s best interests.
